Terms of Service

These terms govern your use of LabSafe, a web application for tracking safety equipment inspections (“LabSafe”, “the service”, “we”). By creating an account or using the service you agree to them, on behalf of yourself and the organization you use LabSafe for.

1. The service

LabSafe lets your organization record its safety equipment, see which inspections are due, log inspection results, track issues to resolution, send reminders, and export records.

2. Not compliance or legal advice

LabSafe includes inspection schedules and instructions based on our reading of federal and state requirements and consensus standards. They are a starting point, provided for convenience, and may be incomplete, out of date, or not applicable to your facility.

You remain solely responsible for the safety of your workplace and for complying with all laws, regulations, permits and standards that apply to you. Confirm your requirements with your environmental health and safety staff, your fire marshal or the relevant authority. LabSafe is a record-keeping tool; it does not inspect, certify or maintain equipment, and it is not a substitute for professional judgment.

3. Accounts

  • You sign in with a link sent to your email address. Keep access to that mailbox secure; anyone who can read it can sign in as you.
  • The person who creates an organization is its primary admin and is responsible for who is invited, what role they have, and for the subscription.
  • You must give accurate information and be authorized to act for the organization you set up.

4. Free trial, subscription and billing

  • New organizations get one 14-day free trial. A payment card is required to start it.
  • Unless you cancel before the trial ends, your subscription begins and the card is charged the price shown when you signed up.
  • Subscriptions are billed in advance, monthly or annually, and renew automatically until canceled.
  • You can cancel or switch between monthly and annual billing at any time from Account → Plan. Cancellation takes effect at the end of the period already paid for.
  • Payments are not refundable, except where the law requires otherwise.
  • Payments are processed by Stripe. We do not store your card number.
  • We may change prices. We will give you at least 30 days' notice by email, and a change applies from your next renewal.

5. If your subscription ends

If a subscription is canceled or a payment cannot be collected, the organization's account becomes read-only: you can still view and export every record, but not add or change anything. Resubscribing restores full access.

6. Your data

Your organization owns the information it puts into LabSafe: equipment, inspection records, notes, and the names and email addresses of its people. You give us permission to store and process that information only to provide the service. How we handle it is described in the Privacy Policy.

You are responsible for the accuracy of what you record and for having the right to share your team members' contact details with us. Keep your own exported copies of records you are required to retain.

7. Acceptable use

You agree not to:

  • access or attempt to access another organization's data;
  • probe, disrupt or overload the service, or work around its access controls;
  • record false inspection results or use the service to mislead a regulator or auditor;
  • resell the service or use it to build a competing product;
  • use the service in violation of any law.

8. Slack and other integrations

If you connect Slack, LabSafe posts messages to the channel you choose and matches Slack users to LabSafe people by email address. Your use of Slack, Stripe and other third-party services is governed by their own terms. You can disconnect Slack at any time.

9. Availability and changes

We work to keep LabSafe available and your records safe, but we do not guarantee uninterrupted or error-free operation. We may add, change or remove features. If we ever discontinue the service, we will give at least 30 days' notice and keep exports available during that time.

10. Disclaimer of warranties

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and any warranty that the built-in requirements are complete or correct for your facility.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, fines, penalties or citations, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount your organization paid us in the 12 months before the claim arose.

12. Suspension and termination

You may stop using LabSafe at any time. We may suspend or close an account that violates these terms or puts the service or other customers at risk. Where practical, we will give notice and a chance to export your records first.

13. Changes to these terms

We may update these terms. If a change is significant we will notify organization admins by email before it takes effect. Continuing to use the service after that means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in Massachusetts.
